Abstract: If a new state arose through independence from a Member State, how could it achieve accession to the European Union? Would it be left outside the EU and have to negotiate its entry? Or would it negotiate the terms from inside, without leaving the EU? That is the question and we believe there is no clear legal answer for or against it.
