Summary

The new Law 15/2005, by which the Civil Code is modified in terms of separations and divorces, incorporates the possibility of granting a shared custody of children, even if one of the parties does not agree, based on the principle of co-responsibility in the exercise of parental authority over their children. This article pretends to reflect on whether shared custody is based on the two principles that operate in this level: the principle of the minor´s best interests and the principle of equality between men and women.
