Summary

In a context where thousands of citizens in Spain have been evicted from their homes for not paying their mortgage loan, the Court of Justice of the European Union issued in March 2013 a very important sentence in this field. According to this sentence, the Spanish judicial procedures and mortgage laws examined are contrary to European Law for Consumer Protection, as they obstruct or make unviable the defence of consumer interests against unfair contract terms.
