Summary

This brief paper was written before the ruling on the new court fees was published. Nevertheless, the things that have happened since, including the latest judicial resolutions, support some of the points made at the time. Many courts have raised doubts when applying the fees and have cast doubt on their constitutionality. The paper has two aims: to explain the situation faced by those of us who apply the law every day, and to highlight the unconstitutional nature of the ruling. From the data gathered so far, it is clear that fewer cases are being brought before the courts. But the reason for this will need to be examined. Was that the Spanish government´s aim?
